You agree that you will use Strobe for its intended purpose, and in compliance with all applicable laws and regulations: local, state, and national, and international, as applicable. You agree not to use Strobe in a fraudulent, disruptive, aggressive or manipulative manner, for money laundering, or any other inappropriate matter. Strobe reserves the right, in its sole discretion, but has no obligation, to investigate your use of Strobe for compliance with appropriate use and terminate your access to Strobe as a result of such investigation, in order to comply with law, regulation, legal process or government request, or for any other reason or no reason at all.

STROBE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITH NO WARRANTY OF ANY KIND AND YOU ARE USING STROBE AT YOUR OWN RISK. Strobe DISCLAIMS ANY WARRANTY, IMPLIED OR OTHERWISE, REGARDING STROBE, INCLUDING WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. IN PARTICULAR AND WITHOUT LIMITING THE FOREGOING, Strobe DISCLAIMS ANY WARRANTY, IMPLIED OR OTHERWISE, THAT ANY TICKET PURCHASED USING STROBE WILL RESULT IN THE LOWEST PRICE, BIGGEST DISCOUNT, OR FOR THAT MATTER ANY SPECIFIC DISCOUNT IN THE PURCHASE PRICE FOR TICKETS FOR ANY SPECIFIC EVENT.
Your access to Strobe's ticketing sites may be terminated at any time, for any reason or no reason at all, at Strobe's sole discretion.
UNDER NO CIRCUMSTANCES WILL STROBE LABS, INC. NOR ANY OF ITS EMPLOYEES, AGENTS, MERCHANTS, PARTNERS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (INCLUDING EMOTIONAL DISTRESS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF STROBE, WHETHER OR NOT STROBE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL STROBE’S LIABILITY IN CONNECTION WITH YOUR USE OF STROBE EXCEED THE AMOUNTS PAID BY YOU FOR TICKETS OR OTHERWISE IN CONNECTION WITH YOUR USE OF STROBE.
You agree to hold Strobe Labs, Inc., its employees, agents, and representatives, as harmless and indemnify Strobe Labs, Inc. from any third party claim arising from or in any way related to your use of Strobe, including liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs, and attorney fees, of every kind and nature.
Strobe will make every reasonable effort to resolve any disagreements that you have with Strobe. If those efforts fail, by using this App you agree that any claim, dispute, or controversy you may have against Strobe arising out of, relating to, or connected in any way with this Agreement this Site or the purchase or sale of any voucher(s), shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a single arbitrator pursuant to the applicable Rules and Procedures established by AAA (“Rules and Procedures”). You agree further that: (a) the arbitration shall be held at a location determined by AAA pursuant to the Rules and Procedures (provided that such location is reasonably convenient for you), or at such other location as may be mutually agreed upon by you and Strobe; (b) the arbitrator shall apply Rhode Island law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (c) there shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only your and/or Strobe individual claims; and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (d) in the event that you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Strobe will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (e) with the exception of subpart (c) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (c) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither you nor Strobe shall be entitled to arbitrate their dispute.
These Purchase Terms are subject to, and incorporate by this reference, the Terms of Service. Each ticket that you purchase using Strobe is a license to attend a particular event, and is subject to these Purchase Terms and the additional terms set forth on that ticket.
Swipe-to-Buy is an optional feature designed to make the purchasing process faster, more convenient, and more responsive. When you first use Strobe, Swipe to Buy is activated by default. When Swipe to Buy is activated, you understand and accept that all sales are subject to the Refunds and Exchanges section of this agreement, and that by completing the swipe gesture you are consenting to the purchase of an item and that you will be accordingly charged for that item. If you do not wish to use Swipe to Buy, you can easily turn it off in the Settings page of Strobe.
Strobe may, in its sole discretion, choose not to process or to cancel your order for tickets on Strobe in certain circumstances that Strobe deems appropriate in its sole discretion. Strobe also reserves the right, in its sole discretion, to take steps to verify your identity to process your order. Strobe will either not charge you or refund the charges for orders that we do not process or cancel. In the event of a cancellation of an event, please contact email@example.com for information on receiving a refund.
Before purchasing tickets, carefully review the event details. Unless explicitly stated otherwise, all sales are final. If an event is canceled or rescheduled, Strobe will provide you with a ticket to the rescheduled show, and if there is no rescheduled show, Strobe will only then refund the cost of your ticket.
In addition, you will not dispute or otherwise seek a “chargeback” from the company whose credit card you used to purchase tickets from Strobe. Should you do so, your tickets may be canceled, and Strobe may, in its sole discretion, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using Strobe.
All ticket prices for events that occur in the United States are stated in U.S. Dollars.
Strobe acts as an independent agent to those who are promoting or otherwise providing the events for which you purchase tickets, such as venues, teams, artists’ representatives and fan clubs, promoters and leagues (“Event Providers”). If you purchase a ticket through Strobe, you will either be purchasing that ticket from: (1) Strobe; or (2) the Event Provider.
If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting an order, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with Strobe whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. Strobe will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
When purchasing tickets on Strobe, you are limited to a specified number of tickets for each event (also known as a “ticket limit”). The default of this limit is one ticket per customer per event.
Orders are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order that will cause an order to be canceled. In these cases, please verify your billing address with your bank and/or credit card issuing company before making another purchase attempt.
Different combinations of delivery methods may be offered. Please carefully review the list of delivery methods offered during the purchase process.
The default for events. Tickets will be mailed to your provided shipping address free of charge. If the event is in the United States, then you will only be able to use this method if you have a United States billing address.
You assume all risks incidental to the event for which a ticket is issued, whether before, during or after performance, and you waive any claims for personal injury or death against Strobe on behalf of yourself and any accompanying minor.
Event Providers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with Event Provider rules. Breach of terms or rules will terminate your license to attend the event without refund. A ticket is a revocable license and admission may be refused upon refunding the ticket’s face amount. A ticket is not redeemable for cash.
You and your belongings could be searched when you enter the event. You consent to such searches and waive any related claims that may arise. If you choose not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, bundles and containers.
Unlawful resale of tickets (or attempted resale) is grounds for seizure and cancellation without compensation. A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written authorization is given by Strobe.
